Excellency,

1 . I have the honour to acknowledge receipt of Your Excellency's letter of 25 July 1996, which reads as follows:

    "Excellency,

    I have the honour to refer to the Memorandum of Understanding signed on October 5, 1990 between the Government of Canada (hereinafter called "CANADA") and the Association of South East Asian Nations (hereinafter called "ASEAN"), acting on behalf of the Governments of its Member Countries namely Brunei Darussalam, Indonesia, Malaysia, Philippines, Singapore and Thailand (hereinafter called collectively the "Governments") concerning the Canada-ASEAN Regional Training program (hereinafter called the "Project").

    I wish to inform you that CANADA is agreeable to propose that the Memorandum of Understanding shall be considered as remaining in full force and effect until the time when the Project is completed.

    CANADA is also agreeable to reflect into the Memorandum of Understanding the recent accession to ASEAN of the Government of the Socialist Republic of Vietnam (hereinafter called "VIETNAM").

    I therefore propose the following modifications to the actual terms and conditions of the Memorandum of Understanding:

  1. The heading of the Memorandum of Understanding (frontispiece and page 1) is deleted and replaced by the following:

      "Memorandum of Understanding between the Association of South East Asian Nations (hereinafter called "ASEAN"), acting on behalf of the Governments of its Member Countries namely -Brunei Darussalam, Indonesia, Malaysia, Philippines, Singapore, Thailand and Vietnam (hereinafter called collectively the "Government"), and the Government of Canada (hereinafter called "Canada") concerning the Canada-ASEAN Regional Training Program".


  2. The preamble of the Memorandum of Understanding is deleted and replaced by the following:

      "ASEAN, on behalf of the Governments, and CANADA desiring to record an understanding concerning a Canadian development assistance Project, have agreed as follows:"


  3. Section 1.02 of the Memorandum of Understanding is amended by adding paragraph (c) to it:

      "(c) in respect of VIETNAM, to be a subsidiary arrangement made pursuant to the General Agreement on Development Cooperation dated June 21, 1994."


  4. This Letter shall be read and construed with the Memorandum of Understanding signed on October 5, 1990.


    If the foregoing is acceptable to ASEAN and the Governments, this Letter together with ),our affirmative Letter in reply shall constitute an agreement between ASEAN, acting on behalf of the Governments, and CANADA and shall come into force from the date of this Letter, with retroactive effect to March 31, 1996.

2. I have the honour to confirm that Your Excellency's letter and this reply shall constitute an agreement on the amendments to the Memorandum of Understanding (MOU) for the Project "The Canada-ASEAN Regional Training Program (RTP)", by which Vietnam is included in the project, with the revised MOU entering into force on the date of this reply with retroactive effect to 31 March 1996.
